Human Resources professional know that employee leave rights can
extend well beyond time provided under the federal Family Medical Leave and
California Family Rights Acts. Courts and government agencies (such as
the EEOC and DFEH) dramatically expanded potential leaves when recognizing
leave as a reasonable accommodation under the ADA and the FEHA. Military,
witness, crime victim and even Civil Air Patrol status create leave
rights well beyond that provided under more commonly known laws.
There is another new trend in leave law:
Caregiver Leave. Like the ADA’s expansion of leave as a form of
reasonable accommodation, the right to caregiver leave relies on other
employment laws – such as age, gender and marital status discrimination laws –
to create new leave rights in the workplace. This becomes even more
significant as Boomers age and they, as well as their children, face the
greatest caregiver obligations of any post-war generation.
This seminar will focus on the emerging law of
caregiver discrimination, especially the EEOC’s published guidelines and “best
practices” addressing “caregiver discrimination.” We will focus on issues
identified by the EEOC such as sex-based discrimination, unlawful stereotyping,
the tension between lawful performance-based decisions and unlawful
discrimination, and “associational” claims. We will also look at recent
trends in claims and litigation, as well as courts’ initial reaction to this
evolving area.
Caregiver discrimination claims have been taking employers
by surprise – there are few guidelines, and even fewer personnel policies,
addressing them. Arm yourself with valuable information about this
emerging and dangerous area of the law.
Richard C. Rybicki is principal counsel with Rybicki
& Associates | P.C., a management-side labor and employment law firm
